
terms of service
This is an Agreement between Paw Pack Canine Adventures & Training (''contractor'') and the Client (''owner'').
The ''client'' is of the opinion that the ''contractor'' has the relevant and necessary skills, qualifications and experience to provide services to the ''client''. The ''contractor'' is agreeable to providing the relevant services to the ''client'' on the terms and conditions set out within this ''agreement''.
In accordance to the relevant New Zealand service and contract laws and bylaws, the client acknowledges that entering services with the "contractor" serves as agreeable to the Terms of Service without way of signed signature.
SERVICES PROVIDED
The ''client'' hereby agrees to engage the ''contractor'' to provide the ''client'' with the following services (the ''services''):
- initial behavioural assessment
- pack adventures
- adventure weekends
- private consults and training
- board and train
- homestay and boarding
TERMS OF AGREEMENT
The "client" confirms that they are the legal owner of the dog.
This agreement may be terminated at any time by the ''contractor'' without notice.
This agreement may be terminated at any time by mutual agreement of both ''parties''.
The obligations of both the ''contractor'' and the “client” will end upon termination of this agreement.
The term of this agreement (the ''term”) will begin on the date that this agreement is received by the ''client'' and will remain in full force and effect indefinitely until terminated as provide in this agreement.
The services provided will also include any other tasks which the ''parties'' may collectively agree on. The ''contractor'' hereby agrees to provide such services to the ''client'' on an as required basis.
The "client" has disclosed all relevant information regarding the dog’s history and understands it is the "client's" responsibility to keep the "contractor" informed of any changes to the dog’s behaviour or health in the future.
PAYMENT, CANCELLATIONS & TERMINATION
All services are payable in advance, failure to provide payment prior to the service date will be perceived as the ’’client’’ providing notice of cancellation and service/s will not be provided, in turn, late payment fees and/or cancellation fees may apply.
The ''client'' must provide 48 hours' notice (prior to their normal pick up timeframe) for all and any cancellations to booked services. Failure to provide the required notice period will result in full balance of the booked service payable by the “client”.
If the ''client'' wishes to pause or suspend services for longer than three consecutive weeks, they will be required to provide 21 days (3 weeks) written notice to the “contractor”.
If either ''party'' wishes to terminate this agreement, the terminating party will be required to provide 21 days (3 weeks) written notice to the other respective party.
If the ''client'' breaches the termination of services clause within this agreement without providing notice, an invoice totaling the sum that the ''client'' would otherwise be liable for during the 21 days notice period, will be issued and liable by the ''client''.
Home stay and boarding services are payable in full & advance for any statutory holiday dates, and the Christmas and New Year period (1st December – 1st February). Off peak home stay bookings require a 50% deposit for security. Home stay and boarding bookings cancelled 14 days or more from the booking date, are eligible for a full refund, while any bookings cancelled within 14 days from the booking date are non-refundable.
Interest payable on any overdue amount under this agreement is charged at a rate of 15.00%.
TRANSPORT & SECURITY
The ''client'' will provide the ''contractor'' with sufficient access to the ''client'' property for the sole purpose of collecting and transporting dog(s).
The “contractor’’ will provide a suitable vehicle for transportation at all times, with a current Warrant of Fitness (WOF), vehicle licensing (REGISTRATION) and Road User Charges (RUC) license.
The “contractor’’ agrees that all drivers transporting clientele will hold a valid, clean driver's license.
EMERGENCY CONTACT
The 'client'' agrees to provide the "contractor" with a name and contact number for an individual/s who can make approved decisions in regard to the dog(s) in an emergency, in the instance where the registered owner is unable to do so, or uncontactable.
The ''client'' agrees if any medical problems develop whilst their dog is in the care of the "contractor", the ''client'' authorises the "contractor" to do whatever they believe is necessary for the safety, health and well-being of the dog. In turn, the ''client'' agrees to pay all expenses incurred.
The "contractor" will endeavour to contact the ''client'' as soon as possible using the contact information the ''client'' has provided.
AUTONOMY
Except otherwise stated in this agreement, the ''contractor'' will have full control over all operations, methodology, and decision making in relation to the provision of services in accordance with the agreement. The ''contractor'' will work autonomously and not at the direction of the ''client''. However, the ''contractor'' will be responsive and respectful to the needs and concerns of the ''client''.
CONFLICT OF INTEREST
The ''client'' acknowledges that there is a conflict of interest where the services provided within this agreement are exclusive; meaning that neither party will engage in, enquire in, or solicit services for the provision of same and/or similar services, without written consent from the ''contractor''.
SOCIAL MEDIA
The “client'' agrees to provide consent to the ''contractor'' to hereby use photos, videos, and other electronic content of their dog/s on social media & advertisement platforms for marketing purposes.
PERFORMANCE
The parties agree to do everything necessary to ensure that all terms within this agreement take effect.
DISPUTE RESOLUTION
The "contractor" will endeavour to resolve any dispute between the "client" and "contractor" without the need for Court proceedings. Any such attempt is without legal prejudice.
CONFIDENTIALITY
Confidential information (the ''confidential information'') refers to any information relating to the business of the ''client'' which would be proprietary to the ''client'' - including, but not limited to; accounting records, business processes, and client records and that is not known in the industry of the ''client' and where the release of that confidential information could be expected to cause harm to the ''client''.
The ''contractor'' agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any confidential information which the ''contractor'' has obtained, except as authorized by the ''client'' or as required by law. The obligations of confidentiality will apply during the term and will survive indefinitely upon termination of this agreement.
All written and oral information and material disclosed or provided by the ''client'' to the ''contractor'' under this agreement is confidential information regardless of whether it was provided before or after the date that this agreement took effect, or how it was provided to the ''contractor''.
LIABILITY
The “client” understands and acknowledges the risk of off leash exercise and group socialisation, however expects and upholds the “contractor” to taking all appropriate measures or management and handling at all times.
The “client" agrees that the "contractor" will not be held responsible for any loss, injury or death that occurs while your dog/s are in their care.
The "client" shall indemnify and hold the "contractor" harmless and not at liability of and from all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys' fees and costs, arising out of or relating to the work of the "contractor".
The "client" agrees that the "contractor" will not be held liable for any consequential damages or damages beyond replacement value of the dog.
The "client" agrees that they are responsible for any veterinary bills, and any costs incurred if their dog causes injury to property, another dog/animal or human whilst they are in the "contractors" care.
The "client" agrees to honestly declare all necessary information regarding the dog’s health and/or behavioural problems that may risk the safety of the contractor and other clients.
This indemnification will survive the termination of this agreement.
GOVERNING LAW
This agreement is governed by New Zealand service and contract laws & bylaws.
In accordance with said service and contract laws & bylaws; clients who engage in paid services are not required to return a signed copy of these terms, as, engagement in services acts as agreement to the terms set out above.
