This Agreement is entered into between Paw Pack (“Contractor”) and the Client (“Client”). The Contractor agrees to provide dog walking, training, socialization, boarding, homestay, transportation, and related services to the Client in accordance with the terms and conditions set out in this Agreement. By engaging, booking, purchasing, or continuing to use any services provided by the Contractor, the Client acknowledges that they have read, understood, and agree to be bound by these Terms of Service. The Client acknowledges that acceptance of these Terms of Service may be provided electronically and does not require a physical signature. Acceptance may be evidenced by, including but not limited to, submitting a booking request, completing a registration form, making payment for services, requesting services, or otherwise engaging the Contractor to provide services. This Agreement shall be governed by and interpreted in accordance with the laws of New Zealand.
General Terms
The Client warrants that they are the legal owner, or an authorized representative of the legal owner, of the dog(s) receiving services under this agreement.
The Contractor reserves the right to terminate this agreement immediately and without notice where the Contractor reasonably believes that continuing services may pose a risk to the safety, welfare, or wellbeing of any person, animal, or property, or where the Client has breached any term of this agreement.
This agreement may also be terminated at any time by mutual written agreement between the Parties.
Upon termination of this agreement, all rights and obligations of the Parties shall cease, except for any obligations that have accrued prior to the date of termination, including any outstanding fees, charges, or liabilities.
The term of this agreement shall commence on the date services first begin and shall continue until terminated in accordance with the terms of this agreement.
Services provided under this agreement may include structured pack walks, training, socialization, boarding, homestay services, and any other services that may be agreed upon in writing between the Parties from time to time. Services will be provided on an ongoing or as-required basis, subject to availability.
The Client confirms that they have disclosed all information known to them regarding the dog’s health, behavioral history, temperament, training history, reactivity, aggression, bite history, medical conditions, and any other information that may reasonably affect the provision of services.
The Client acknowledges an ongoing obligation to promptly notify the Contractor of any changes to the dog’s health, behavior, temperament, training, or circumstances that may affect the safe and appropriate provision of services.
Services
The Contractor provides dog-related services, including but not limited to:
Behavioral assessments
Structured pack walks and socialization activities
Private training and consultations
Board and train programs
Homestay and boarding services
Transportation services
Adventure days, excursions, and special events
The Parties acknowledge that the services provided may vary from time to time. The Contractor reserves the right to introduce, modify, suspend, or discontinue services at its discretion.
Any additional services agreed to between the Contractor and the Client shall be deemed to form part of this Agreement and be subject to these Terms and Conditions.
Payment, Cancellations and Termination
Homestay and boarding fees do not include the cost of daily walks, unless otherwise agreed in writing.
Clients wishing to change from concession payments to weekly payments must provide a minimum of 4 weeks' written notice before their current concession expires.
Bookings cancelled more than fourteen (14) days prior to the commencement date are eligible for a full refund, less any non-refundable deposit already paid. Bookings cancelled within fourteen (14) days of the commencement date are non-refundable.
All home stay and boarding services that include statutory holidays, public holidays, or dates falling between 1 December and 1 February, must be paid in full at the time of booking. For all other homestay and boarding bookings, a non-refundable deposit equal to 50% of the booking value is required to secure the reservation.
Should the Client wish to pause or suspend services for a period exceeding three (3) consecutive weeks, a minimum of twenty-one (21) days’ written notice must be provided to the Contractor.
The Contractor reserves the right to suspend or refuse services where an account remains overdue. In addition, Either party may terminate this agreement by providing twenty-one (21) days’ written notice to the other party. Where the Client terminates services without providing the required notice period, the Contractor reserves the right to invoice the Client for any scheduled services that would have occurred during the twenty-one (21) day notice period. Such charges will become immediately payable by the Client.
The Client agrees to provide a minimum of 48 hours’ notice for any cancellation or change to their regular scheduled service days. Cancellations or schedule changes made with less than 48 hours’ notice will be charged at the full service rate.
Due to the limited availability of places and the allocation of regular ongoing bookings, all regularly scheduled services are charged as booked, including services scheduled on public holidays. Public holiday bookings are not eligible for cancellation under the standard 48-hour cancellation policy.
Transport and property access
The Client agrees to provide the Contractor with safe and reasonable access to the Client’s property for the sole purpose of collecting, transporting, and returning the dog(s) receiving services under this agreement.
The Client is responsible for ensuring that access arrangements are secure, functional, and clearly communicated to the Contractor. The Contractor will not be liable for delays, missed services, or additional charges resulting from inaccessible premises, faulty access arrangements, or inaccurate instructions provided by the Client.
The Contractor will provide and maintain a suitable vehicle for the safe transportation of dog(s). All vehicles used for transportation will comply with applicable New Zealand legal requirements, including current vehicle registration, Warrant of Fitness (WOF), and Road User Charges (RUC) where required.
The Contractor agrees that all persons engaged in the transportation of dog(s) will hold a current and valid New Zealand driver’s license appropriate for the class of vehicle being operated.
Reasonable care will be taken to ensure the safety and welfare of all dog(s) during transportation. However, the Client acknowledges that transportation carries inherent risks and agrees that the Contractor shall not be liable for injury, illness, loss, or death arising from circumstances beyond the Contractor’s reasonable control.
Emergency Contact & Veterinary Care
The Client agrees to provide the Contractor with the name and contact details of at least one emergency contact who is authorized to make decisions regarding the dog(s) in the event that the Client is unavailable or cannot be contacted.
If the dog becomes ill, injured, or requires urgent veterinary attention while in the care of the Contractor, the Client authorizes the Contractor to seek veterinary treatment and take any action reasonably necessary to protect the health, safety, and welfare of the dog.
The Contractor will make reasonable efforts to contact the Client and/or the nominated emergency contact before any non-emergency treatment is authorized. However, where immediate veterinary treatment is deemed necessary by the Contractor or attending veterinarian, the Client authorizes treatment to proceed without prior approval.
The Client accepts full responsibility for all veterinary, medical, transportation, and associated costs incurred in relation to the treatment or care of the dog, except where such costs arise directly from the Contractor’s negligence.
The Contractor will endeavor to notify the Client as soon as reasonably practicable of any illness, injury, emergency, or veterinary treatment involving the dog.
Forced Closures
The Contractor shall not be liable for any failure, interruption, delay, cancellation, or inability to provide services where such circumstances arise from events beyond the Contractor’s reasonable control, including but not limited to severe weather, flooding, natural disasters, vehicle breakdown, road closures, illness, injury, government restrictions, emergencies, civil unrest, or other unforeseen events.
Where reasonably practicable, the Contractor will endeavor to notify the Client as soon as possible of any disruption to services. The Contractor reserves the right to modify, reschedule, shorten, relocate, or cancel services where necessary to protect the safety and welfare of clients, dogs, staff, contractors, or members of the public.
No compensation, damages, refunds, or credits shall be payable in respect of any service affected by circumstances beyond the Contractor’s reasonable control, unless otherwise agreed.
Exclusivity & Non-Circumvention
The Client acknowledges that the Contractor may engage employees, contractors, assistants, or subcontractors in the provision of services.
The Client agrees not to directly engage, solicit, or attempt to engage any employee, contractor, assistant, or subcontractor introduced through the Contractor’s business for the provision of substantially similar services, except with the prior written consent of the Contractor.
Nothing in this clause prevents the Client from obtaining dog-related services from other businesses or service providers.
Social Media & Marketing
The Client grants the Contractor permission to photograph, film, and otherwise capture images or recordings of the dog(s) while participating in services provided under this agreement.
The Client authorizes the Contractor to use such photographs, videos, and recordings for marketing, promotional, educational, advertising, and social media purposes without compensation to the Client.
The Contractor agrees not to publish personal information relating to the Client without the Client’s consent, except where required by law.
Performance of Agreement
The Parties agree to take all reasonable steps and do all things necessary to give effect to the terms and intent of this agreement.
Dispute Resolution
In the event of any dispute arising under this agreement, the Parties agree to first attempt to resolve the matter through good faith discussion and negotiation before commencing legal proceedings.
Any discussions, negotiations, or settlement attempts undertaken for the purpose of resolving a dispute shall be conducted on a without prejudice basis and shall not be relied upon in any subsequent legal proceedings except as required by law.
Confidentiality & Privacy
The Contractor acknowledges that, during the course of providing services, they may become aware of personal, confidential, or sensitive information relating to the Client, their household, their property, or their dog(s).
The Contractor agrees to keep such information confidential and will not disclose, share, or use that information for any purpose other than providing services under this agreement, except where:
(a) the Client has provided consent;
(b) disclosure is required by law; or
(c) disclosure is reasonably necessary to protect the health, safety, or welfare of any person or animal.
This obligation of confidentiality applies during the term of this agreement and will continue following the termination of services.
The Client acknowledges that the Contractor may retain records relating to services provided, including booking information, contact details, veterinary information, behavioral assessments, photographs, invoices, and service records, where reasonably necessary for business, legal, insurance, or record-keeping purposes.
Liability & Assumption of Risk
The Client acknowledges that participation in dog walking, group walks, socialization activities, training, transportation, boarding, homestay services, and off-leash exercise involves inherent risks, including but not limited to injury, illness, escape, property damage, altercations between animals, and, in rare circumstances, death.
The Client acknowledges and accepts these risks and authorizes the Contractor to exercise reasonable discretion in the handling, management, transportation, training, socialization, and care of the dog(s).
The Contractor agrees to exercise reasonable care, skill, and diligence in providing services. However, except to the extent caused by the Contractor’s negligence, willful misconduct, or breach of legal obligations, the Contractor shall not be liable for any injury, illness, loss, death, theft, escape, property damage, or other loss suffered by the Client or their dog(s).
The Client agrees to indemnify and hold harmless the Contractor, its employees, contractors, and agents from and against any claims, liabilities, damages, costs, losses, or expenses arising from the actions or behavior of the Client’s dog(s), including injury to persons, animals, or property, except to the extent caused by the Contractor’s negligence.
The Client remains responsible for all veterinary expenses, medical costs, property damage, and other expenses arising from the actions or behavior of their dog(s) while receiving services under this agreement.
The Client warrants that all information provided regarding the dog’s health, temperament, behavioral history, training history, reactivity, aggression, bite history, and medical condition is accurate and complete to the best of their knowledge. The Client agrees to promptly notify the Contractor of any changes that may affect the safety or suitability of the dog for services.
To the fullest extent permitted by law, the Contractor’s liability arising out of or in connection with this agreement shall be limited to the amount paid by the Client for the services giving rise to the claim.
The obligations contained within this clause shall survive the termination of this agreement.
Governing Law
This agreement is governed by New Zealand service and contract laws & bylaws.
